Insurance Coverage and Appeals

PPO also has considerable experience in handling commercial and personal lines coverage disputes for its clients. Members of the firm have comprehensive knowledge of the intent of coverage forms, the underwriting process and risk management. An appreciation of underwriting and risk management is essential to the proper handling of coverage questions because insurance policies, and particularly policies issued to a business entity, are drawn to fit the particular needs of the insured.

The firm is frequently asked to provide coverage opinions and defend coverage disputes in declaratory judgment actions and on appeal. Members of the firm have appeared before the Minnesota Supreme Court and Minnesota Court of Appeals in coverage matters on numerous occasions. To date, we have prevailed on the vast majority of these coverage matters. We have also successfully defended Miller-Shugartclaims, as well as claims alleging "bad faith" against our clients.

In an effort to reduce risk for our clients, we have assisted our clients in the revision of garage liability, personal, and commercial automobile policies, and have written manuscript endorsements to shift the exposure to third-parties. We have also written employment practices liability policies, and our called upon by our clients to consult on policy drafting issues.
